一、 引言

長(zhǎng)期以來(lái),“人工智能”(簡(jiǎn)稱(chēng)“AI”)一直是知識(shí)產(chǎn)權(quán)和競(jìng)爭(zhēng)法學(xué)者的關(guān)注焦點(diǎn)。然而,與知識(shí)產(chǎn)權(quán)和反壟斷不同,1. 二、場(chǎng)景設(shè)置:什么是人工智能,什么是反不正當(dāng)競(jìng)爭(zhēng)法,后者能對(duì)前者監(jiān)管起到什么作用

四、公平

人工智能和反不正當(dāng)競(jìng)爭(zhēng)法最明顯、同時(shí)也是最復(fù)雜的潛在“共同點(diǎn)”是“公平”原則本身。從表面上看,反不正當(dāng)競(jìng)爭(zhēng)法中的“公平”和人工智能語(yǔ)境中的“公平”可能被認(rèn)為除了術(shù)語(yǔ)之外并無(wú)共同之處:人工智能爭(zhēng)論中的“公平”大多被理解為平等原則和禁止“有偏見(jiàn)”的歧視,反不正當(dāng)競(jìng)爭(zhēng)法中“公平”旨在保護(hù)競(jìng)爭(zhēng)或至少與競(jìng)爭(zhēng)相關(guān)的利益。15. 事實(shí)證明,在日漸由人工智能決定的市場(chǎng)秩序方面,反不正當(dāng)競(jìng)爭(zhēng)法將發(fā)揮切實(shí)可行的作用。它可以在許多方面促進(jìn)中央監(jiān)管模式的落實(shí),旨在為了社會(huì)利益最佳的利用這一新技術(shù)。因此,反不正當(dāng)競(jìng)爭(zhēng)法能夠而且不應(yīng)該只是被動(dòng)地因應(yīng)和調(diào)整其既有標(biāo)準(zhǔn),而是應(yīng)憑借其理論靈活性,積極參與制定應(yīng)對(duì)人工智能所提出的多種挑戰(zhàn)所需的新標(biāo)準(zhǔn)。與此同時(shí),人工智能所引發(fā)的法律問(wèn)題為進(jìn)一步反思和完善反不正當(dāng)競(jìng)爭(zhēng)法的本質(zhì)和核心提供了契機(jī),反不正當(dāng)競(jìng)爭(zhēng)法是一個(gè)仍未有得到充分理解的法律體系。由于其特有的靈活性,反不正當(dāng)競(jìng)爭(zhēng)法對(duì)社會(huì)、經(jīng)濟(jì)和技術(shù)變革表現(xiàn)出高度的依賴(lài)性和回應(yīng)性。這些變化目前和今后一段時(shí)間均是由人工智能推動(dòng)的。反不正當(dāng)競(jìng)爭(zhēng)法可能會(huì)以這種方式被重塑與改進(jìn),成為調(diào)整數(shù)字經(jīng)濟(jì)、競(jìng)爭(zhēng)秩序和社會(huì)的真正基石。
