【摘 要】知識(shí)經(jīng)濟(jì)時(shí)代，科學(xué)技術(shù)是第一生產(chǎn)力，在不斷的發(fā)展過(guò)程中，我國(guó)于科研方面產(chǎn)生了大量的研究成果，能夠?yàn)樯鐣?huì)發(fā)展注入動(dòng)力，但是從目前來(lái)看，在科技檔案管理中，存在著知識(shí)產(chǎn)權(quán)保護(hù)不到位的情況，不僅影響了科技轉(zhuǎn)化的效率，也對(duì)經(jīng)濟(jì)的穩(wěn)定發(fā)展產(chǎn)生了一定影響。本文從科技檔案管理和知識(shí)產(chǎn)權(quán)保護(hù)的特點(diǎn)出發(fā)，分析了當(dāng)前科技檔案管理總知識(shí)產(chǎn)權(quán)保護(hù)存在的問(wèn)題，并就如何做好科技檔案管理中的知識(shí)產(chǎn)權(quán)保護(hù)提出了幾點(diǎn)合理化建議。

【Abstract】In the era of knowledge economy， science and technology are the first productive forces. In the process of continuous development， our country has produced a large number of research achievements in scientific research and can inject power into the social development. However， in the present time，there is a situation in which the protection of intellectual property is not in place in the management of scientific and technological archives， which not only affects the efficiency of the transformation of science and technology， but also the stable development of the economy. There is a certain impact. Based on the characteristics of the management of science and technology archives and the protection of intellectual property rights， this paper analyzes the existing problems in the protection of the general intellectual property rights of the current scientific and technological archives management， and puts forward some reasonable suggestions on how to do well in the protection of intellectual property in the management of scientific and technological archives.

0 前言

知識(shí)產(chǎn)權(quán)保護(hù)是一個(gè)非常復(fù)雜的問(wèn)題，涉及經(jīng)濟(jì)、社會(huì)、法律等多方面因素，做好科技檔案管理，是知識(shí)產(chǎn)權(quán)保護(hù)中一項(xiàng)不容忽視的內(nèi)容。但是就目前而言，在科技檔案管理中，相關(guān)部門(mén)并沒(méi)有重視知識(shí)產(chǎn)權(quán)保護(hù)工作，也因此引發(fā)了不少問(wèn)題，導(dǎo)致知識(shí)產(chǎn)權(quán)的泄漏和流失?；诖耍枰陂_(kāi)展科技檔案管理工作的同時(shí)，做好知識(shí)產(chǎn)權(quán)保護(hù)，為社會(huì)經(jīng)濟(jì)發(fā)展提供可靠的推動(dòng)力。

1 科學(xué)檔案管理與知識(shí)產(chǎn)權(quán)保護(hù)

科技檔案指在科學(xué)研究、生產(chǎn)技術(shù)等活動(dòng)的基礎(chǔ)上形成的各種文件資料，其本身具有專業(yè)性、多樣性、成套性和現(xiàn)實(shí)性的特點(diǎn)，具備情報(bào)功能、知識(shí)儲(chǔ)備與依據(jù)憑證功能，能夠促進(jìn)經(jīng)濟(jì)效益的提高，推動(dòng)生產(chǎn)力發(fā)展?？萍紮n案實(shí)際上屬于知識(shí)產(chǎn)權(quán)的一個(gè)重要組成部分，做好科技檔案管理，對(duì)于知識(shí)產(chǎn)權(quán)保護(hù)及利用有著積極作用，應(yīng)該得到足夠的重視。

2 科學(xué)檔案管理中知識(shí)產(chǎn)權(quán)保護(hù)存在問(wèn)題

2.1 歸檔環(huán)節(jié)

科技檔案的完整性是保證其質(zhì)量的關(guān)鍵，其形成依賴日常積累。在科學(xué)研究活動(dòng)中，會(huì)產(chǎn)生大量的科技文件，這些文件是構(gòu)成科學(xué)檔案的基礎(chǔ)，需要做好積累工作。但是不少科研單位將目光一味放在科研計(jì)劃落實(shí)上，卻沒(méi)有重視科技文件的整理和歸檔工作，具體來(lái)講，一是，科研實(shí)驗(yàn)記錄缺乏規(guī)范性，科研報(bào)告缺乏完整性，沒(méi)有能夠及時(shí)將科技文件移交給檔案管理部門(mén)；二是，存在肢解檔案資料的情況，只將一般性資料移交，關(guān)鍵資料則被留下；三是一些核心內(nèi)容和工藝數(shù)據(jù)直接被省略，影響了科研檔案的完整性和真實(shí)性[3]。

2.2 利用環(huán)節(jié)

一是，知識(shí)產(chǎn)權(quán)意識(shí)淡薄。當(dāng)前，許多高校和科研院所的科研人員思想僵化，缺乏更新，知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)淡薄，對(duì)知識(shí)產(chǎn)權(quán)保護(hù)相關(guān)的法律法規(guī)及政策掌握不夠全面，導(dǎo)致知識(shí)產(chǎn)權(quán)出現(xiàn)嚴(yán)重的流失現(xiàn)象；二是，知識(shí)產(chǎn)權(quán)自然流失。計(jì)劃經(jīng)濟(jì)時(shí)代，科研工作與經(jīng)濟(jì)發(fā)展脫節(jié)，部分檔案部門(mén)將科技檔案長(zhǎng)期封鎖，使得其無(wú)法轉(zhuǎn)化為經(jīng)濟(jì)效益。而在知識(shí)經(jīng)濟(jì)時(shí)代，科研成果從發(fā)明到應(yīng)用的周期一再縮短，新技術(shù)新產(chǎn)品的更新也不斷加快遞，知識(shí)更新周期越來(lái)越短，如果知識(shí)產(chǎn)權(quán)無(wú)法及時(shí)轉(zhuǎn)化為生產(chǎn)力，則會(huì)出現(xiàn)自然流失的問(wèn)題；三是，技術(shù)保密工作不強(qiáng)。新時(shí)期，科學(xué)檔案的利用更加頻繁，但是由于管理不足，導(dǎo)致部分知識(shí)產(chǎn)權(quán)被竊取，或者將合作成果或者組織科研成果據(jù)為己有，謀取私利，從而影響了知識(shí)產(chǎn)權(quán)功能的充分發(fā)揮[4]。
