【摘 要】法律英語特點(diǎn)鮮明，要求嚴(yán)格的、規(guī)范的、正式的語體。翻譯英語法律文件，要準(zhǔn)確認(rèn)識法律英語的專業(yè)特點(diǎn)，同時也要仔細(xì)分析法律英語文本的句子結(jié)構(gòu)。

法律語言不同于一般的大眾話語，是一種特殊的語言。法律語言在法律活動中具有舉足輕重的地位。法律英語是指法律界通用的書面英語（包括法律、法規(guī)、條例、協(xié)定等），尤其是指律師起草法律文件、合同慣常使用的語言（孫萬彪，2003）。在專門用途英語（English for Special Purposes）中，法律英語是最具特色的一種。

一、法律英語的特點(diǎn)

1.英語詞匯的專業(yè)含義

法律英語詞匯有其特定的專業(yè)含義。例如，award（獎品）在法律用語中是“裁定或判決”的意思； damages（損害，名詞復(fù)數(shù)）要翻譯成“損害賠償金”。類似的詞語還有action（law suit）， avoid（cancel），等。

2.使用書面用語

在英語合同文本中，不用but而用provided that，不用after而用subsequent，不用before而用prior。其他的書面用語還有：construe（explain）， deem（consider），operate， same。

3.使用拉丁文、法語書寫的詞語和諺語

英語法律文本中，由于歷史原因，至今還能看到用拉丁文和法語書寫的詞語和諺語。詞語如ad hoc（專門的）， de facto（事實上）， in re（關(guān)于）， per se（自身），pro rata（按比例）。拉丁文諺語如：Caveat emptor（買者自慎之）；Facta sunt potentiora verbis（事實勝于雄辯）。

4.使用行話、套話

為了使要表達(dá)的意思更為準(zhǔn)確，常使用現(xiàn)成的行話、套話，如and for no other purposes； shall not be deemed a consent等。

二、英語法律文件的翻譯

法律英語的句子結(jié)構(gòu)以長句為主，往往出現(xiàn)從句套從句的現(xiàn)象，翻譯時主要采用“切割法”，即在原文句子中的主從句連接處、連詞處、關(guān)系代詞處切斷。按意群，按其邏輯關(guān)系，譯成漢語分句，使譯入語層次分明。

原文：In case of the removal of the President from office， or of his death， resignation， or inability to discharge the powers and duties of the said office， the same shall devolve on the Vice President， and the Congress may by law provide for the case of removal， death， resignation or inability， both of the President and Vice President， declaring what officer shall then act as President， and such officer shall act accordingly， until the disability be removed， or a President shall be elected.

譯文：如果總統(tǒng)免職、死亡、辭職或無能履行總統(tǒng)的權(quán)力與職責(zé)，應(yīng)由副總統(tǒng)代理行使總統(tǒng)的權(quán)力與職責(zé)。國會可依法對總統(tǒng)和副總統(tǒng)的免職、死亡、辭職或無能履行的情況作出具體規(guī)定（提供法律依據(jù)），并宣布屆時由哪個官員來代理行使總統(tǒng)的權(quán)力與職責(zé)，在上述無能履行情況結(jié)束前或新總統(tǒng)選舉產(chǎn)生前，該官員應(yīng)相應(yīng)地代理行使權(quán)力與職責(zé)。

評析：此句從總體來看是一句并列句，在各分句中有主從句及從句中的并列句。按照長句“切割法”的翻譯方法，按各分句從句的邏輯關(guān)系逐一譯出，并不難譯。原文“In case of the removal of ...on the Vice President”為句子的第一部分。句中the same 在法律英語中常常用作代詞，是指上面提及的事，避免重復(fù)，這里是指the powers and duties of the said office。句中devolve on 是動詞，意為（of work， duties）be transferred or passed to sb，為漢語行文的需要，在翻譯時，可以進(jìn)行詞義轉(zhuǎn)換，把英語中的動詞轉(zhuǎn)譯成漢語中的名詞。原文“and the Congress may by law ...a President shall be elected”為句子的第二部分。該部分包含兩層意思，第一層：the Congress may by law provide for the case of removal， death， resignation or inability， both of the President and Vice President， declaring what officer shall then act as President.第二層：and such officer shall act accordingly， until the disability be removed， or a President shall be elected為復(fù)合句。句中the disability一詞在翻譯時應(yīng)將其深層含義譯出，該詞是指“上述提及的免職、死亡、辭職或無能履行情況”。
