An analysis of the testimonial evidence in 12AngryMenfrom the perspective of philosophy of mind(p. 1)

NIESicheng(General Course Department, Zhengzhou Shengda University of Economics, Business & Management, Zhengzhou 451191, China)

Testimonial evidence refers to the testimonies delivered by witnesses and the statements made by litigants in a court of law. It plays a crucial role in fact finding. The ultimate goal of forensic linguistics is to solve legal problems related to language by means of linguistic theory and methodology. This study explores the relationship between testimonial evidence and facts from the perspective of philosophy of mind and gives an exemplary analysis of the testimonial evidence in the movie 12AngryMen. In the relationship of representation among the three worlds, fact finding in a court of law is essentially a process of retrieving the physical world from the linguistic world with testimonial evidence as the starting point. The topological nature of testimonial evidence helps to clarify the basic facts as well as the disputes. According to the doublet structure of consciousness for testimonial evidence, intentionality analysis can be applied to ascertain the judgment on disputes.
