Talents of Governance Appear After Good Laws Are Made.
先制定良好的法律,然后才會出現(xiàn)擅長治理的人才?!爸畏ㄕ摗笔屈S宗羲法思想的核心觀點,顛覆了儒家思想中重“人治”而輕“法治”的傳統(tǒng),在中國歷史上獨樹一幟。在近代,“治法論”被仁人志士們視為中國現(xiàn)代法治思想的先聲。
Good laws should be made first, then there will be talents in governance. As the core viewof Huang Zongxi’s thought, it subverts the Confucian tradition emphasizing “rule by man”over “rule by law” and is thus unique in Chinese history. In modern times, it was regardedby men of lofty ideals as the herald of modern Chinese thought on the rule of law.
◎ 使先王之法而在,莫不有法外之意存乎其間。其人是也,則可以無不行之意;其人非也,亦不至深刻羅網(wǎng),反害天下。故曰有治法而后有治人。(黃宗羲《明夷待訪錄·原法》)
(假如古代圣王的法度還在,那么在法度之外還保存著立法的本意。這樣的話,如果是合適的人在位,就可以自由施展他的政治理念,即使當(dāng)政的不得其人,也不至于嚴(yán)峻苛刻地執(zhí)行法律,反而為害天下。所以說,先有良好的法度,然后才能出現(xiàn)可以治理好天下的人才。)
If the laws made by sage kings of the previous dynasties still exist, the original intent oflegislation beyond will be preserved. In this way, if the right person is in power, he will befree to practice his political philosophy. Even if he is not the right person, he cannot be toostrict and harsh in the enforcement of law, to the harm of the state.
